The customer must be over 18 years old and the legitimate owner of the pieces sent. We reserve the right to request additional documentation in accordance with current regulations.
Once the pack is received, we will issue an offer based on the current official gold price. The customer has the free storage period set out in the Custody, storage fees and unclaimed items section to accept or reject the offer. Once the offer is accepted, payment is made by transfer within 24 business hours.
If the customer does not accept the offer, we will return all pieces at no cost and with insurance equivalent to the original shipment. Photographic records of the appraisal will be kept for reference.
The purchase of gold and other precious metals by OroSeguro concerns goods whose price depends directly on fluctuations in international financial markets, as contemplated by Article 103(b) of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users. Accordingly, the 14-calendar-day right of withdrawal provided for in Article 102 of the same text does not apply to the sale of investment gold to OroSeguro. Acceptance of the appraisal offer constitutes the customer's express waiver of that right of withdrawal, formalised through the customer's explicit consent in the appraisal-acceptance flow, in accordance with applicable regulations.
This vault and storage policy applies to transactions in which the customer has accepted the contract terms including the Article 103(b) right-of-withdrawal exception (see the 'Right-of-withdrawal exception' section). OroSeguro provides 30 days of free, fully insured vault storage starting from the date the valuation offer is sent to the customer. During this period the customer may accept the offer, request the free return of the pieces, or request a new appraisal. From day 31 onward, a custody and insurance fee of €1.00 per day will accrue. At any time the customer may choose to: (a) accept the original offer in full — OroSeguro will honour the original offer amount without market adjustment and without deducting accrued custody fees, regardless of how much time has passed or how metal prices have moved; or (b) recover the items — OroSeguro will return the items by insured shipment upon settlement of accrued storage fees and return shipping costs by the payment method on file or as otherwise arranged via OroSeguro customer support. OroSeguro will send periodic reminder communications to the customer's email address on file before any adverse action. If 90 calendar days have passed since the offer was sent and the customer has not chosen either option, OroSeguro will send a final email notice granting 14 additional calendar days to act. If no instructions are received within that period, the pieces will be deemed abandoned and will be liquidated at the LBMA PM fix or equivalent published international spot benchmark for the relevant metal on the date of liquidation. The proceeds of the liquidation will be applied first to accrued custody fees; any surplus will be held in the customer's oroseguro.es account balance for collection. If no oroseguro.es account is active, the surplus shall be remitted to the bank account on file from the original transaction, or to the postal address of record. After a period of unclaimed status, surplus is treated under applicable Spanish law on unclaimed property. Nothing in this section limits the customer's statutory rights as a consumer under Spanish or EU law.
We comply with Law 10/2010 on the prevention of money laundering. We may reject operations that do not pass verification checks and will notify the authorities if necessary.
These terms are governed by Spanish law. Any dispute shall be submitted to the courts corresponding to the consumer's domicile, as required by Spanish consumer-protection law.
